The accident went onto the state traffic record at about 12:08 p.m. ET, the Georgia Department of Transportation said. Investigators were still working the southbound side more than an hour and a half later.

Authorities gave no estimated time for the blocked lanes to reopen, FOX 5 Atlanta reported.

The Gwinnett County Police Department confirmed the death and is the agency handling this scene. A fatal accident is worked by a specialist accident investigation unit rather than a patrol officer, and that unit prepares the report that becomes the public record of the event.

Georgia’s Open Records Act, O.C.G.A. § 50-18-71, makes public records available for personal inspection and copying except where a court order or another law exempts them. Subsection (b)(1)(A) requires an agency to produce responsive records within a reasonable time not exceeding three business days of receiving a request, and to give a description and a timeline where records cannot be produced that fast. What does Georgia’s Move Over law require at a blocked interstate scene?

Gwinnett County police worked a fatal accident investigation in blocked lanes of a live interstate here, which is the situation Georgia’s Move Over law addresses. The statute is O.C.G.A. § 40-6-16, known as the Spencer Pass Law, and Georgia’s appellate courts treat a violation as a misdemeanor traffic offense.

Subsection (b) applies to a driver approaching a stationary authorized emergency vehicle displaying flashing yellow, amber, white, red or blue lights. That driver must change into a lane not adjacent to the emergency vehicle where conditions allow it, and where a lane change is impossible, unlawful or unsafe, must slow below the posted limit to a speed reasonable for the conditions and be prepared to stop.

Subsection (c) extends the same requirement to stationary towing or recovery vehicles, highway maintenance vehicles and utility service vehicles that are using traffic cones or showing flashing or revolving yellow, amber or white lights. A violation of subsection (b) carries a fine of up to $500; a violation of subsection (c) up to $250.

Georgia is a universal helmet state. O.C.G.A. § 40-6-315(a) is the motorcycle helmet law, and it requires anyone operating or riding on a motorcycle to wear protective headgear meeting standards set by the commissioner of public safety.
