What happened at the vacant Dairy Queen on North Avenue?

Fire gutted an empty former Dairy Queen restaurant early Wednesday in the Old Fourth Ward, and Atlanta firefighters held it to that one building.

Atlanta Fire Rescue crews were sent out at about 1:40 a.m. on Aug. 26, 2026, to the 400 block of North Avenue. The building sits at the corner of North Avenue and Parkway Drive, WSB-TV reported.

Flames were coming through the roof of the building.

Nobody was hurt. No firefighters were injured, and an extensive search of the structure turned up no one inside.

By daylight much of the restaurant had been reduced to a burned-out shell, FOX 5 Atlanta reported.

The restaurant had been out of business for months, so the fire had the run of an empty building with nobody inside to notice it early.

How did Atlanta firefighters find the fire?

The fire was spotted by chance. A city fire unit was already rolling to a different call at the nearby Clermont Hotel and saw flames coming from the restaurant as it drove past.

That first call, at the hotel, turned out to be unfounded.

The head start mattered. Crews were already working the restaurant fire at roughly the moment the first 911 call about it reached dispatchers.

Battalion Chief Christopher Martin of Atlanta Fire Rescue put the timing plainly to Atlanta News First: "Luckily, it was two blocks away so we had real quick response."

Fires in closed buildings are usually reported late, by a passer-by or a neighbor who sees smoke from the street. A crew that happens to be driving past is an unusual piece of luck.

Was anyone inside the burning building?

No one was found. The restaurant had been closed and empty, and crews went through it after knocking the fire down.

Investigators found indications that someone may have been staying in an upstairs loft area, FOX 5 Atlanta reported. Martin told Atlanta News First that crews found a person possibly squatting upstairs.

Firefighters believe whoever had been using that space left before the search began.

No injuries were reported at the scene.

Searching a burned building takes longer than searching an occupied one. Crews cannot assume the stairs, the floors or the roof structure are still where a floor plan says they are.

It did not. A three-story apartment building stands directly behind the restaurant, close enough to be threatened by the flames.

Keeping the fire off that building was the main job once crews arrived, and they managed it.

Distance is the whole problem on a block like this one. Older commercial buildings in the Old Fourth Ward sit close to their neighbors, and a fire venting through a roof throws heat sideways as well as up.

Why do crews search a vacant building before calling it clear?

A building with no tenants is not the same thing as a building with no people in it. Firefighters treat an empty structure as potentially occupied until a search says otherwise, which is why the North Avenue restaurant was walked through even after the flames were knocked down.

The loft area upstairs is the reason that matters here. Signs of someone staying in a shuttered building change how the structure is searched and how long crews stay in it.

The second half of the job is what the fire service calls exposure protection — putting crews and water between a burning building and whatever stands next to it. In this case that was the apartment block at the rear.

Federal fire researchers flag both problems in vacant buildings: nobody is inside to notice a fire early, and the condition of the structure is unknown to the crews who enter it.

Those researchers make the point from the other direction as well. Vacant buildings are sometimes used as shelter, and a crew going in has no way to know how many people are inside or where they would be.

What caused the North Avenue Dairy Queen fire?

That has not been settled. The cause remains under investigation.

The roof is where investigators think it began, WSB-TV reported.

Firefighters said they are working from theories about how it began but have not confirmed one.

No agency has drawn a link between the person who may have been staying upstairs and the origin of the fire.

Who decides what caused a fire in Atlanta, and when does the state step in?

Inside the city limits, the origin-and-cause question belongs to Atlanta Fire Rescue investigators. They read the burn pattern, work backward to the area where the fire started and classify it as accidental, undetermined or incendiary.

Georgia layers a state office on top of that. Every fire a department responds to — accidental or deliberately set — has to be reported to the Office of Insurance and Safety Fire Commissioner under O.C.G.A. § 25-2-32, which also makes the state fire marshal the keeper of Georgia's fire-loss record.

The same chapter gives that office teeth when a fire looks suspicious. Under O.C.G.A. § 25-2-33, the state fire marshal, a designated deputy, the director of the Georgia Bureau of Investigation or a local fire chief can require an insurance company to hand over its policy file, its premium and claims history and its own investigative material on a fire loss.

The duty runs the other way too. An insurer that has reason to suspect a fire was set must notify the state fire marshal and turn over what it has gathered.

Nothing in the North Avenue case has been called incendiary. Firefighters have said only that the cause is open.

The classification matters beyond the case file. It decides whether a fire ends as a line in the state fire-loss record or turns into a criminal investigation with a second agency attached to it.

What does Georgia law say about burning a vacant building?

Georgia grades arson by what burned, not by how badly it burned, and an empty building is not automatically a lesser offense.

Arson in the first degree, at O.C.G.A. § 16-7-60, covers a dwelling house belonging to someone else whether it is occupied, unoccupied or vacant. It also reaches any structure designed to be lived in, and separately any structure at all that is insured against fire loss where the damage is done without the consent of both the insurer and the insured.

Arson in the second degree, at O.C.G.A. § 16-7-61, is the catch-all for buildings and structures that the first-degree section does not describe — knowingly damaging another person's building by fire or explosive without that person's consent. A conviction carries a fine of up to $25,000, one to ten years in prison, or both.

A closed restaurant is not a dwelling, so a first-degree charge would have to rest on one of the other routes in that section — the insurance subsection, a co-owner's rights, or circumstances in which it was reasonably foreseeable that human life might be endangered.

None of that has been alleged here. Firefighters have not confirmed a cause.

The consent language is doing most of the work in both sections. Georgia writes its arson law around damage to property that belongs to someone else, or that someone else holds a financial stake in, done without permission.

Is staying in a vacant building a crime in Georgia?

It can be. Criminal trespass sits at O.C.G.A. § 16-7-21, and it turns on authority and notice rather than on the building being empty.

A person commits the offense by knowingly and without authority entering someone else's premises for an unlawful purpose, by entering after being told the entry is forbidden, or by staying on after being told to leave. The same section also covers intentionally damaging another person's property where the damage is $500 or less.

No one has been accused of anything in this case. Atlanta Fire Rescue described physical signs of someone staying upstairs.

How common are fires in vacant buildings?

Common enough to have their own federal study. The U.S. Fire Administration's topical report on vacant residential building fires counted an estimated 23,800 such fires a year across the country from 2013 to 2015.

Those fires caused roughly 75 deaths, 200 injuries and $785 million in property loss annually, and made up 6 percent of all residential building fires.

The spread figures bear directly on what happened on North Avenue. In that data set, 53 percent of vacant-building fires grew to involve the whole structure and another 10 percent pushed past it into neighboring property.

Intentional acts were the single largest cause in the federal figures, at 34 percent, though those figures cover vacant homes rather than shuttered businesses.

The report flags the detection problem in the same breath. With no occupants to smell smoke or hear an alarm, fires in empty buildings tend to be found later and to cost more by the time they are.

How can the public get the fire incident report?

The incident report on the North Avenue fire is a City of Atlanta record, held by Atlanta Fire Rescue, and it is reachable through the Georgia Open Records Act.

Under O.C.G.A. § 50-18-71, an agency has to produce records that answer a request within a reasonable time, and no longer than three business days from receiving it.

Where only part of the file is ready inside that window, the agency has to release what it has and account for the rest. The law does not require an agency to create a record that did not exist when the request arrived.

An open origin-and-cause investigation is the usual reason a fire narrative is withheld or released in redacted form.

Fire departments also file their incident data with the state under the reporting duty in Title 25, so the state fire-loss record will carry this fire whatever the cause turns out to be.
