What does Georgia's armed robbery law say?

Georgia defines armed robbery at O.C.G.A. § 16-8-41. A person commits the offense when, with intent to commit theft, he or she takes property of another from the person or the immediate presence of another by use of an offensive weapon, or any replica, article or device having the appearance of such a weapon.

The same section sets the punishment on conviction at death, life imprisonment, or imprisonment for not less than 10 nor more than 20 years. It also makes robbery by intimidation a lesser included offense of armed robbery.

The second charge sits in a different chapter of the code. Conspiracy to commit a crime, at O.C.G.A. § 16-4-8, applies when a person, together with one or more others, agrees to commit a crime and any one of them commits an overt act toward carrying it out. The sentence for conspiracy is keyed to the crime that was conspired to, and where that crime is punishable by death or life imprisonment, the statute sets a term of not less than one nor more than 10 years.
